This Privacy Policy explains how College Bound Jocks LLC ("CBJ") and Talent Tracker Inc. (collectively, "we," "us," or "our") collect, use, disclose, retain, and protect personal information when you use our websites, recruiting platform, mobile applications, events, communications, and related products and services (collectively, the "Services").
CBJ and Talent Tracker Inc. are separate legal companies under common ownership that work together to provide softball recruiting services. Depending on the Service you use, one or both companies may collect or process your information. Information may be shared between CBJ and Talent Tracker Inc. as described in this Policy to operate the Services, support users, promote athletes, administer events, and improve the recruiting experience.
By using the Services, you acknowledge the practices described in this Policy. If you do not agree, please do not use the Services. This Policy should be read together with any applicable Terms of Use, event waiver, subscription terms, and consent forms.
1. Scope of This Policy
This Policy applies to information collected through collegeboundjocks.com, the Talent Tracker platform and related applications, CBJ-produced athlete profiles and videos, recruiting events and showcases, webinars, email and text communications, sales and customer support, and other services that link to or reference this Policy.
This Policy does not govern third-party websites or services that we do not control, even if our Services contain links to them.
2. Information We Collect
Information You Provide
We may collect the following categories of information when you create an account, build or manage a profile, register for an event, purchase a service, communicate through the platform, or contact us:
Identity and contact information, such as name, username, mailing address, email address, telephone number, date of birth or age, and parent or guardian information.
Athlete recruiting information, such as graduation year, school, travel team, positions, handedness, height, athletic measurements and performance metrics, statistics, academic information, GPA, test scores, awards, recruiting interests, target schools, camp attendance, and commitment status.
Profile and media content, such as photographs, biographies, skills videos, highlight videos, schedules, tournament locations, news, links, and other content submitted for a player, coach, team, or organization profile.
Coach, school, and team information, such as employment or affiliation, title, biography, roster information, school email address, recruiting notes, favorites or watch lists, camps, schedules, and communications.
Communications and community content, including direct messages, emails, support requests, survey responses, webinar participation, and other communications sent through or about the Services.
Transaction information, such as products or subscriptions purchased, payment status, invoices, discounts, and purchase history. Payment card information is processed by our payment providers, including Square and Stripe. We generally do not store complete payment card numbers or card security codes.
Account and security information, such as login credentials, verification information, account settings, and records used to protect or authenticate an account.
Event information, such as registrations, emergency contacts, waivers, consent forms, attendance, photographs, video recordings, livestream footage, evaluations, and performance results.
Information Collected Automatically
When you use the Services, we and our service providers may automatically collect device and usage information, including IP address, browser type, device type, operating system, pages or features viewed, referring URLs, dates and times of access, approximate location derived from IP address, cookie identifiers, and information about interactions with emails or the Services.
We do not use a user's precise mobile-device GPS location to allow coaches to locate an athlete. Tournament and field information may instead be supplied by users through schedules or event information.
Information From Other Sources
We may receive information from parents or guardians, athletes, travel coaches, college coaches, schools, teams, tournament directors, event partners, affiliated organizations, publicly available sources, referral partners, social media services, payment processors, and other service providers. A person submitting information about someone else represents that they are authorized to provide it.
3. How We Use Information
We may use personal information to:
Create, verify, administer, and secure accounts and profiles.
Provide athlete recruiting profiles, video services, evaluations, metrics, platform tools, events, showcases, webinars, and customer support.
Allow authorized users to search for, evaluate, organize, follow, favorite, and communicate with athletes, coaches, teams, and schools.
Send profile-interest notifications, direct messages, service announcements, event information, account notices, and other requested communications.
Process purchases, subscriptions, registrations, discounts, refunds, and related records.
Promote athletes and Services where the athlete or parent or guardian has authorized the relevant use.
Personalize and improve the Services, analyze usage, troubleshoot problems, develop features, and measure marketing effectiveness.
Prevent fraud, misuse, harassment, security incidents, and violations of our terms or policies; protect users and the public; and comply with legal obligations.
Send marketing communications in accordance with applicable law and your choices.
Create aggregated or de-identified information that does not reasonably identify an individual.
4. Athlete Profiles, Recruiting Visibility, and Communications
Talent Tracker is designed to help softball athletes connect with college coaches and other authorized members of the recruiting community. Information placed in an athlete profile may therefore be visible to college coaches, travel coaches, team or organization administrators, platform personnel, and other users as permitted by the Service's features and account settings. Profile information may be used by authorized users for recruiting, evaluation, team administration, event planning, and communication.
Athletes and parents or guardians should carefully review information before adding it to a profile. Sensitive information such as a home address, personal telephone number, or academic records should be shared only when necessary and through the most appropriate available setting. No online platform can guarantee that an authorized recipient will not copy or further disclose information received through the Services.
The Services may allow users to send direct messages or other communications. We may access, preserve, or review communications when reasonably necessary to provide support, maintain safety and security, investigate reported conduct, enforce our terms, or comply with law. Users should not use the Services to send unlawful, abusive, exploitative, or inappropriate content.
5. How We Disclose Information
We may disclose personal information in the following circumstances:
Between CBJ and Talent Tracker Inc. to provide integrated recruiting, media, event, customer-support, billing, marketing, and administrative services.
To users and recruiting participants as directed by you or as necessary for profile visibility and platform features, including college coaches, travel coaches, schools, teams, organization administrators, athletes, and parents or guardians.
To service providers that perform work for us, such as website and application hosting, cloud storage, software development, payment processing, email and messaging delivery, analytics, customer support, security, video hosting or streaming, and marketing services.
To event venues, tournament partners, evaluators, photographers, videographers, livestream providers, insurers, and other vendors involved in an event or purchased service.
When required by law, subpoena, court order, or lawful government request, or when reasonably necessary to protect rights, safety, property, users, or the public; investigate fraud or misconduct; or enforce our agreements.
In connection with a merger, financing, reorganization, sale of assets, acquisition, or other business transaction, subject to appropriate safeguards.
With your consent or at your direction.
We do not rent personal information to third parties for their independent marketing. We do not disclose complete payment-card information because it is handled by payment processors. Certain disclosures involving advertising or analytics technologies may be treated as a "sale" or "sharing" under some state privacy laws even when no money is exchanged; where applicable, users may exercise the opt-out rights described below.
6. Payments
Payments may be processed by Square, Stripe, or another disclosed payment provider. Payment providers collect and process payment information under their own privacy notices and security practices. 7. Cookies and Similar Technologies
We and our providers may use cookies, pixels, web beacons, software development kits, and similar technologies to keep users signed in, remember preferences, secure accounts, understand use of the Services, measure communications, improve performance, and support marketing. Browser or device settings may allow you to block or delete some technologies, but doing so may affect Service functionality. Where required, we will request consent or provide additional choices through an appropriate cookie or privacy control.
8. Children and Minor Athletes
Our Services involve youth athletics, and many athlete users are under 18. A parent or legal guardian should create, authorize, or supervise a minor athlete's account and the information submitted for that athlete. By submitting information about a minor, the parent, guardian, or other authorized adult represents that they have authority to do so and consents to the collection, use, and disclosure described in this Policy and any applicable consent form or waiver.
The Services are not intended for children under 13 to create or manage accounts on their own. We do not knowingly collect personal information online directly from a child under 13 without verifiable parental consent when such consent is required by the Children's Online Privacy Protection Act (COPPA). If we learn that information was collected from a child under 13 without appropriate authorization, we will take reasonable steps to delete it or obtain the required consent. A parent or guardian may contact us to review, correct, or request deletion of a child's personal information, subject to applicable law and legitimate retention needs.
We do not knowingly sell or share, as those terms are defined by applicable state privacy law, the personal information of users under 16 without legally required authorization.
9. Data Retention
We retain personal information for as long as reasonably necessary to provide the Services, maintain an account or recruiting profile, complete transactions, administer events, preserve authorized media or recruiting records, comply with legal, tax, accounting, insurance, and contractual obligations, resolve disputes, enforce agreements, and protect the Services and users. Retention periods vary according to the type of information and the reason it was collected.
When information is no longer needed, we may delete or de-identify it. Information may remain for a limited period in backups, archives, fraud-prevention records, transaction records, legal files, or content already lawfully distributed or published with authorization.
10. Information Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no internet transmission, platform, or storage system is completely secure, and we cannot guarantee absolute security. Users are responsible for protecting passwords, controlling access to their accounts, using secure devices and networks, and promptly notifying us of suspected unauthorized access.
11. Your Choices and Privacy Rights
Depending on where you live and subject to applicable law, you may have the right to request access to, correction of, deletion of, or a copy of certain personal information; to withdraw consent where processing relies on consent; to object to or restrict certain processing; or to opt out of certain targeted advertising, sale, sharing, or profiling activities. You may also have the right to appeal a decision concerning a privacy request and to be free from unlawful discrimination for exercising privacy rights.
You may update many account details by signing in to your account. You may unsubscribe from marketing emails using the unsubscribe link in the message. We may still send non-marketing communications necessary to administer an account, transaction, event, or Service.
To submit a privacy request, contact us using Section 16. We may need to verify your identity and authority before acting. An authorized agent, parent, or guardian may submit a request where permitted by law. We will respond within the time required by applicable law. Certain information may be exempt from a request, including information we must keep to comply with law, complete a transaction, prevent fraud, protect safety, exercise legal rights, or maintain internal records.
12. California Privacy Notice
California residents may have rights under the California Consumer Privacy Act, as amended (CCPA), if it applies to us. These may include rights to know the categories and specific pieces of personal information collected; learn the sources, purposes, and categories of recipients; request correction or deletion; receive information in a portable format; and opt out of sale or sharing for cross-context behavioral advertising. We will not unlawfully discriminate against a person for exercising applicable rights.
The categories of personal information we may collect are described in Section 2, the purposes are described in Section 3, and the categories of recipients are described in Section 5. We do not knowingly sell or share the personal information of consumers under 16 without the affirmative authorization required by law.
California's "Shine the Light" law may permit certain California residents to request information about disclosures of personal information to third parties for their own direct-marketing purposes. Requests may be submitted using the contact details in Section 16.
California users under 18 who have registered accounts may request removal of content they publicly posted. Removal may not erase every copy, including information retained as required by law or information independently submitted, copied, or reposted by others.
13. Do-Not-Track and Browser Privacy Signals
Some browsers offer a Do-Not-Track signal, but no uniform standard governs all such signals. We do not currently respond to Do-Not-Track signals. Where required by applicable law, we will process recognized opt-out preference signals, such as Global Privacy Control, for the browser or device sending the signal.
14. International Users
Our Services are operated from the United States. If you access them from another country, your information may be transferred to, stored in, and processed in the United States, where privacy laws may differ from those in your location. Where applicable, users may contact us to exercise rights granted by their local law or to ask about the safeguards used for international transfers.
15. Changes to This Policy
We may update this Policy from time to time. The revised version will show a new "Last Revised" date and will become effective when posted unless otherwise stated. If changes are material, we may provide additional notice through the Services, by email, or by another appropriate method. We encourage users to review this Policy periodically.
